Frequently Asked Questions

What is healthcare compliance?

Healthcare compliance means following laws and rules set by authorities to ensure healthcare organizations operate legally and ethically. This includes laws on patient privacy, billing, safety, and quality of care.

Why is compliance important?

Healthcare compliance is important because it helps ensure that healthcare organizations follow laws and regulations, protect patient rights, maintain high standards of care, and avoid legal issues. It helps prevent fraud, waste, and abuse, ensures patient safety, and promotes trust in the healthcare system. Compliance also reduces the risk of fines, penalties, and damage to an organization’s reputation.

Who is responsible for Compliance at Vynca?

Compliance is a team sport. This means that everyone is responsible for compliance at Vynca, for doing the right thing, and speaking up when something isn't right. In turn, it’s the Compliance Department’s responsibility to create a program that promotes honest, ethical behavior at Vynca.

Who is Vynca’s Compliance Officer?

Vynca's Compliance Officer is Melissa Searle. She can be reached at 925-395-3057 or by emailing her directly at melissasearle@vyncacare.com.

What are the key healthcare regulations?

HIPAA (Health Insurance Portability and Accountability Act):
Protects patient privacy and the confidentiality of health information.
‍
HITECH Act:
Promotes the adoption of electronic health records (EHR) and strengthens HIPAA protections.

False Claims Act:

‍
Anti-Kickback Statute:

‍

‍
Includes provisions for healthcare reform, including regulations for insurance coverage and patient protections.

What does it mean to make an anonymous compliance report?

When you make a compliance report anonymously, your identity remains unknown to the Compliance Department or anyone else when making the report. You can report anonymously through the Compliance Hotline by choosing not to report your name or other identifying information when submitting a report.

What does it mean to make a confidential compliance report?

Confidential reporting means that when you make a report, your identity will be made known to the Compliance Department, but that information will remain private and will not be shared with anyone else to the extent allowable when conducting a thorough and fair investigation.

Why does Vynca check all employees, contractors and Board Members against government exclusions lists?

Exclusion checks involve screening individuals and entities against government exclusion lists, such as the Office of Inspector General – List of Excluded Individuals/Entities (OIG-LEIE). These checks are essential for healthcare compliance to ensure that Vynca does not employ or do business with anyone excluded from participating in federally funded healthcare programs.

Vynca conducts exclusion checks for all employees, contractors, and Board Members upon hire or engagement, and every month thereafter, to confirm they are eligible to work with government healthcare programs like Medicare or Medicaid.
